1. About
1.1 About Jaaspire. Jaaspire (the "Platform") is a social media and content-sharing website and application service that allows users to create a profile, upload photos, videos, and other content ("User Content"), and engage with other users through a combination of free and paid features. Creators can offer subscriptions to their content and can make individual posts available as premium content ("premium content"). Followers can also send rewards to Creators. Subscriptions are billed directly through the applicable app store or web payment provider; rewards and premium content unlocks are paid for using Jaaspire's virtual aapp credits, "Stars." Jaaspire is operated by realdrseattle, a company registered in Washington, USA.
1.2 Acceptance of Terms. These Terms of Service ("Terms") govern your access to and use of Jaaspire, including any content, functionality, virtual aapp credits, subscriptions, and services offered on or through the Platform. By registering an account or using Jaaspire, you accept and agree to be bound by these Terms. If you do not agree, you must not access or use the Platform.
1.3 Eligibility – Adults Only. Jaaspire is only available to individuals 18 years of age or older. By using Jaaspire, you represent and warrant that you are at least 18 (or the age of majority in your jurisdiction) and that you have the legal capacity to enter into a binding contract. No persons under 18 may register or access the Platform. If you do not meet these requirements, you must not use Jaaspire. Jaaspire's Privacy Policy describes how we verify age and identity.
1.4 Changes to Terms. We reserve the right to modify or update these Terms at any time in our sole discretion. If we make changes, we will post the updated Terms on the Platform and update the "Last Updated" date. For material changes, we will provide reasonable advance notice (for example, by email or in-app notification) where required by applicable law. Changes are effective when posted (or on a later effective date if stated) and apply to use of Jaaspire thereafter. By continuing to use Jaaspire after changes take effect, you agree to the revised Terms.
1.5 Electronic Communications. By using Jaaspire, you consent to receive communications from us electronically, including email notifications and messages on the Platform. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing. If you wish to withdraw consent to electronic communications, you must notify us at [email protected]; however, because we provide our services electronically, doing so may result in termination of your account.
1.6 User Content and Interactions. We do not own or control the User Content that users post on Jaaspire. Views or opinions expressed in User Content are those of the users, not of Jaaspire. All transactions and interactions regarding User Content—including subscriptions, premium content, and rewards—are between users (Creators and Followers). Jaaspire is not a party to any agreement or dealing between users, except (a) as the seller/merchant of record where required by an app store or payment provider, and (b) as a facilitator of Stars transactions and Creator payouts as described in Sections 4 and 5.
1.7 Jaaspire's Role in Payments — Two Payment Rails. Jaaspire operates two distinct payment mechanisms, and it is important that you understand the difference:
(a) Subscriptions (Rail 1 — direct billing). Creator subscriptions are recurring purchases billed directly through Apple's App Store (In-App Purchase), Google Play Billing, or—on the web—our third-party payment provider. Subscriptions are not purchased, renewed, or maintained using Stars. When you subscribe through a mobile app, the app store is the merchant of record, the charge is governed by that app store's terms and billing rules, and the subscription auto-renews until cancelled through the app store (see Section 6). When you subscribe on the web, our web payment provider processes the charge and the subscription auto-renews until cancelled through your Jaaspire account settings (see Section 6).
(b) Stars (Rail 2 — virtual credits, rewards and premium only). Stars are a limited, revocable, non-exclusive, non-transferable license to access eligible in-app digital content and interactions. Stars are used only for rewards and premium content unlocks. When a Follower purchases Stars, the transaction is between the Follower and Jaaspire (or the relevant app store or payment provider), and the Follower obtains the limited license described above. Stars have no independent monetary value outside the Platform, are not legal tender, are not backed by any government, and cannot be redeemed by Users for currency, transferred to other Users, or used outside Jaaspire.
When a Follower spends Stars on a Creator's content or interactions (rewarding or unlocking premium content), Jaaspire records the transaction, deducts the Stars from the Follower's balance, and credits the Creator's separate "Creator Earnings" balance with an amount calculated under Jaaspire's then-current internal exchange rate and revenue-share rules, net of platform fees, payment-processing fees, applicable taxes, and any other disclosed deductions. Creators do not own or hold Stars and cannot withdraw or redeem Stars; they may request payout of their Creator Earnings in real currency under Sections 4 and 5.
(c) Limited agent — Stars-funded transactions only. For Stars-funded transactions (rewards and premium content), Jaaspire acts as a limited agent of the Creator. When a Follower spends Stars on a Creator's eligible content or interactions, the Creator is deemed as having accrued the corresponding Creator Earnings at the time the Stars are spent, the Follower's obligation to the Creator is fulfilled, and the Creator's claim is solely against Jaaspire for the Creator Earnings shown in the Creator dashboard. This agent construct does not apply to subscriptions, which are collected by the applicable app store or web payment provider; subscription revenue share is governed by Section 5.
1.8 Our Rights. We reserve the right at any time, and without liability or prior notice, to: modify, suspend, or terminate the Platform or any portion of it; restrict, limit, suspend, or terminate any user's access for any reason, including violation of these Terms; remove or delete content that, in our reasonable opinion, violates these Terms or applicable law; monitor use of the Platform (including User Content or messages) to ensure compliance; investigate suspected misuse or illegal behavior and cooperate with law enforcement; disclose information about your use where we reasonably believe it necessary to comply with law or legal process or to protect the safety, rights, or property of Jaaspire or any third party; and change or select the third-party payment processors, app stores, or payout providers used on the Platform.
1.9 Service Availability. From time to time, we may restrict access to part or all of the Platform to perform maintenance or for other operational reasons. We do not guarantee that the Platform, or any content on it, will always be available or uninterrupted.
2. How It Works
2.1 Platform Description. Jaaspire allows you to create a profile and either: become a Creator by uploading and posting User Content (photos, videos, live streams (upcoming), text posts, etc.), some of which you may make accessible only through a paid subscription or premium content unlocks; and/or become a Follower by following or subscribing to one or more Creators to view their content and engage in permitted interactions (such as messaging, live chats, or rewarding). Subscriptions are billed directly through the app store or web payment provider; rewards and premium content unlocks are paid for with Stars.
2.2 Users. The term “User” in these Terms refers to anyone using Jaaspire, whether as a Creator, a Follower, or both. A single person may be both a Follower and a Creator on the Platform. All Users are subject to these same Terms.
2.3 User Content. "User Content" means any media, content, or material (including photos, videos, audio, live streams, text, and graphics) that Users upload, publish, or display on Jaaspire. Creators own their User Content, subject to the licenses granted to Jaaspire and Followers under these Terms.
2.4 Follower Interactions. In addition to viewing content, Followers may interact with Creators through features provided by Jaaspire ("Follower Interactions"), which may include sending direct messages, requesting permitted content, participating in live-stream chats, rewarding (using Stars), or unlocking premium content (using Stars). Access to a Creator's gated content may also require an active subscription, which is billed directly as described in Section 1.7(a).
3. Account Registration
3.1 Creating an Account. To use Jaaspire, you must register and create a user account by providing a valid email address, a unique username, and a secure password. You may be asked to verify your email or identity as part of our security and compliance procedures. You must provide truthful, current, and complete information and keep it up to date.
3.2 Privacy and Data. All information you provide will be handled in accordance with our Privacy Policy. By registering, you consent to Jaaspire's collection and use of your information as described in the Privacy Policy.
3.3 Payment Setup for Subscriptions and Stars. To purchase a subscription, Stars, or any premium feature as a Follower, you must add a valid payment method or use your app store account (Apple ID or Google account) where applicable. By providing a payment method or using an app store account, you authorize our payment processors, app stores, and other billing providers to store your payment credentials and to charge your chosen method for the subscriptions, Stars, and other paid features you elect to purchase.
When you purchase a subscription or Stars through our iOS or Android apps, those purchases are processed through Apple's App Store or Google Play Billing and are subject to their terms, conditions, and refund policies in addition to these Terms. When you purchase on our website or through non-app-store channels, those transactions are processed by the third-party payment provider we select. Jaaspire does not store full payment-card details. We reserve the right to change our authorized payment processors and app-store integrations at any time.
3.4 Earnings Payout Setup (For Creators). To earn money as a Creator, you must add a payout method and verify your identity. This includes providing valid government-issued identification (to confirm you are at least 18 and for tax and legal purposes), submitting any additional forms required by law (for example, U.S. Creators may need to provide an IRS Form W-9, or other country-specific tax forms), and providing bank or payment-account details for receiving payouts. We support certain payout options and may change or add options over time at our discretion.
As a Creator, you will not receive or hold Stars. When Followers spend Stars on your content or interactions, Jaaspire credits your separate Creator Earnings balance in real-currency terms using our internal conversion and revenue-share rules. When Followers subscribe to you, your revenue share is calculated under Section 5 from amounts collected by the app store or web payment provider, net of the app store's or provider's fees and our platform fee. Your Creator Earnings will be paid out via your chosen payout method, subject to our payout schedule, minimum withdrawal thresholds (for example, a minimum payout threshold in your payout currency), applicable holding periods (for example, a 65-day delay to account for refunds and chargebacks), and our right to withhold amounts for refunds, chargebacks, tax withholding, or other lawful reasons. Additional payout terms appear in your Creator dashboard.
3.5 Account Commitments. By registering, you confirm that all information you submit is your own, truthful, accurate, and up to date; you will not impersonate anyone or provide false details; and you have not previously been banned or terminated by Jaaspire (or, if you had a prior account, you have disclosed it and are not circumventing a ban).
You agree to use Jaaspire for your personal use only. You will not sell, rent, sublicense, or transfer your account, create an account on behalf of someone else, or permit others to use your account. You will not use any external or third-party payment method to accept or solicit payment for content or interactions offered through Jaaspire, and you will not encourage Followers to pay you outside of Jaaspire (for example, via direct bank transfer, crypto wallet, or third-party payment app) for content or interactions that should be conducted and paid for through Jaaspire's subscriptions, Stars, or approved in-app payments. All Follower payments for Jaaspire content and interactions must go through Jaaspire's approved payment system.
Jaaspire reserves the right at any time to verify your information and your compliance with these Terms. If we cannot verify your information to our reasonable satisfaction, we may suspend or terminate your account.
3.6 Account Security. You are responsible for maintaining the confidentiality of your login credentials (username and password) and for all activities that occur under your account. You should use a strong, unique password and exercise caution on shared or public devices. Do not share your password with anyone or allow others to access your account. If you believe someone has gained unauthorized access to your account or your account has been compromised, you must notify Jaaspire support immediately at [email protected]. We are not liable for any loss or damage arising from your failure to secure your account.
3.7 Account Disabling. We reserve the right to disable or reclaim any username or account, including where an account is inactive, where required by law, where the account is used in violation of these Terms, or where a username infringes a third party's rights or impersonates another person.
4. Stars (Virtual App Credits)
4.1 Nature of Stars. Stars are virtual app credits. They are licensed, not sold, and grant only a limited, revocable, non-exclusive, non-transferable right to access eligible in-app premium content and interactions (rewards and premium content). Stars have no monetary value, are not redeemable for money by Users, cannot be transferred between Users, and have no value outside Jaaspire. All real‑money charges associated with purchasing Stars or other premium content are processed by third‑party payment providers or app stores on behalf of Jaaspire. By making a purchase, you authorize Jaaspire, our payment processors, and the applicable app store to charge your selected payment method for the amount of the purchase (including any applicable taxes or fees). If your provided payment method fails (for example, due to card expiration, insufficient funds, or a declined transaction) and you do not update it, Jaaspire may suspend or revoke access to the premium content or subscription or prevent further Stars purchases until payment is resolved. Jaaspire is not responsible for any delays or errors by the payment processors or app stores, but we will work to resolve any payment issues that arise to the extent we are able.
4.2 Purchasing Stars. Stars are purchased through the app store (on mobile) or our web payment provider (on the web), at the price shown at the time of purchase. We may change Star pricing, package sizes, and the internal exchange rate at any time on a prospective basis. We may impose purchase, balance, or spending limits.
4.3 Spending Stars. Stars may be spent only on permitted features—currently rewards and premium content unlocks. Once spent, Stars are consumed and non-refundable except as required by law or the applicable app store's policies. We are not obligated to refund Stars for content you have viewed or interactions you have received.
4.4 Expiration and Forfeiture. Unused Stars may expire or be forfeited only to the extent permitted by applicable law. Where prohibited by law, Stars will not expire. On account termination for your breach, unspent Stars may be forfeited to the extent permitted by law.
4.5 No Off-Platform Use. Stars may not be used, exchanged, or settled outside Jaaspire, and may not be used to facilitate any payment outside Jaaspire's approved system.
4.7 Follower Responsibilities For Purchases. All purchases on Jaaspire, including purchases of Stars, premium content unlocks, and rewards, are final. Unauthorized or fraudulent use of payment methods is prohibited. You agree not to initiate unjustified chargebacks, payment disputes, or refund requests after consuming content or using Stars. If you have an issue with a purchase or were charged in error, you agree to contact Jaaspire support first at [email protected], or if the transaction occurred through an app store, to follow that store’s refund process, before escalating to your bank or card issuer.
5. Creator Earnings and Payouts
5.1 Two Revenue Sources. Creator Earnings derive from (a) subscription revenue share, calculated from amounts the app store or web payment provider collects for subscriptions to your content, net of the app store's or provider's fees and our platform fee; and (b) Stars-funded earnings from rewards and premium content, credited as described in Section 1.7(b).
5.2 Revenue Share and Fees. Your revenue-share percentage and all applicable fees are disclosed in your Creator dashboard and may be changed prospectively on reasonable notice. App store fees (for example, Apple's or Google's commission) are deducted before your share is calculated on subscription revenue.
5.3 Holding Periods, Chargebacks, and Refunds. Earnings may be subject to a holding period before becoming withdrawable. We may withhold, reverse, or claw back Earnings attributable to refunds, chargebacks, fraud, or transactions later reversed by an app store or payment provider.
5.4 Payouts. Payouts are made via your chosen method, subject to identity and tax verification (Section 3.4), minimum thresholds, and our payout schedule. You are responsible for all taxes on your Earnings; we may withhold or report amounts where required by law.
5.5 No Withdrawal of Stars. Creators withdraw real-currency Earnings, never Stars.
6. App Store and In-App Purchase Terms
This Section governs purchases made through the Apple App Store and Google Play, and supplements (it does not replace) the terms of those stores.
6.1 Platform-Managed Billing. Subscriptions and Star purchases made in our iOS or Android apps are processed and managed by Apple or Google. The applicable app store is the merchant of record for those transactions, and your purchase is also subject to that store's terms and policies. Where those terms conflict with these Terms regarding the processing of an in-app purchase, the app store's terms control for that transaction.
6.2 Auto-Renewing Subscriptions. Creator subscriptions are auto-renewable. Your subscription automatically renews for successive periods at the then-current price, and your payment method (or app store account) is charged at the start of each renewal period, until you cancel. Renewal pricing and frequency are disclosed at the point of purchase.
6.3 Cancellation.

iOS (Apple): Cancel through your Apple ID subscription settings (Settings → [your name] → Subscriptions). Apple does not provide refunds for the current billing period; cancellation stops future renewals.

Android (Google): Cancel through Google Play → Subscriptions.

Web: Cancel through Settings → Subscriptions → Cancel Subscription in your Jaaspire account.
In all cases, cancellation takes effect at the end of the current paid period; you retain access until then, and you are not charged for further renewals. Jaaspire cannot cancel an app-store-managed subscription on your behalf—Apple and Google require you to cancel through their settings.
6.4 Restore Purchases. On mobile, you may restore eligible prior purchases (such as non-consumable entitlements) through the "Restore Purchases" function in the app, subject to the app store's rules.
6.5 Refunds. Refunds for in-app purchases are handled by Apple or Google under their policies; requests must generally be made to the applicable app store. For web purchases, refunds are governed by Section 7 and applicable law. Stars and consumed content are non-refundable except as required by law or app-store policy.
6.6 Apple-Specific Acknowledgment. Where you use our iOS app, you acknowledge that these Terms are between you and Jaaspire only, not Apple; that Apple has no obligation to provide maintenance or support; that Apple is not responsible for the app or its content; and that Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.
7. Refunds and Consumer Rights
7.1 General. Except as required by applicable law or app-store policy, all purchases are final. Statutory consumer rights (including any mandatory cooling-off or withdrawal rights and remedies for non-conforming digital content under applicable consumer-protection law) are not excluded and apply notwithstanding anything to the contrary in these Terms.
7.2 Digital Content Delivered Immediately. Where you request immediate access to digital content (for example, unlocking premium content) and acknowledge that you lose any applicable withdrawal right upon access, that right may not apply once access has begun, to the extent permitted by law.
8. Intellectual Property and User Content
Intellectual Property
8.1 Ownership of the Platform. Except for User Content, the Platform (Jaaspire) and all content and materials on it or offered through it are the property of Jaaspire or its licensors. This includes, but is not limited to, the website design, software code, databases, aggregated listings of content, text, graphics, logos, button icons, images, audio clips, video clips, data compilations, and overall look and feel of Jaaspire. These are protected by copyright, trademark, trade secret, and other intellectual property or proprietary rights laws. All rights in the Platform not expressly granted to users in these Terms are reserved by us.
8.2 Jaaspire Trademarks. "Jaaspire" and our logos, brand names, domain names, and slogans are trademarks or service marks owned by Jaaspire, Inc. (or its affiliates or licensors). You must not use Jaaspire's name, logos, or branding for any purpose without our prior written consent. All other names, logos, or marks on the Platform that are not owned by us are the property of their respective owners (for example, payment provider names), and their use on Jaaspire is for identification only and does not imply endorsement.
8.3 Your License from Us. Subject to your ongoing compliance with these Terms, Jaaspire grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Platform for your own personal, lawful use, solely to participate in the Jaaspire platform as intended (either as a Creator, Follower, or both), and for no other purpose.
8.4 Restrictions on Use of Platform Materials. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, or transmit any of the material or code on the Platform, except as permitted by law or as follows. You may, for your own personal, non-commercial use, view and temporarily cache copies of the materials as you interact with the Platform (for example, your web browser may automatically cache pages or images, or you may temporarily download content for offline viewing if the Platform allows it). You may print or download a reasonable number of pages of the website for your personal, non-commercial use (for example, a copy of these Terms or a transaction receipt), but not for redistribution. All other uses of any part of the Platform without prior written permission from Jaaspire are prohibited. You may not copy or scrape our content or code for use on other sites, nor use any of our intellectual property in a way not authorized by us. If you breach these Terms and copy or use Platform materials in violation of these rules, your right to use Jaaspire will cease immediately and you must, at our option, return or destroy any unauthorized copies of materials you have made.
8.5 No Transfer of Rights. Using Jaaspire does not give you any ownership of or rights to any aspect of the Platform or its content (aside from your own User Content). When you subscribe to a Creator, unlock content with Stars, or otherwise access content, you obtain only a limited, personal license to view that content through our service—you do not obtain ownership of that content. Likewise, Creators do not obtain ownership of any Jaaspire software or systems by using the service. All rights not expressly granted in these Terms are reserved by Jaaspire.
User Content
8.6 Ownership of Your Content. You retain ownership of all User Content that you create and post on Jaaspire. Jaaspire does not take ownership of your copyrights or other intellectual property in your content. Subject to the licenses granted to us and to other users below, you are free to reuse your content however you like outside the Platform (for example, you can post your own photos/videos to your personal website or other social media).
8.7 License to Jaaspire. By uploading or publishing User Content on Jaaspire, you grant to Jaaspire (and our affiliates, successors, and sublicensees) a worldwide, non-exclusive, royalty-free license to store, use, reproduce, modify (e.g., for formatting or technical purposes), display, perform, distribute, and transmit your User Content in connection with operating the Platform and providing services to you and other users. This license allows us, for example, to:

Host your content on our servers and display it to users (Followers) who are authorized to view it (such as your subscribers).

Transcode or format your videos and images so that they play on different devices and network conditions.

Use small excerpts, thumbnails, or previews of your content to promote your Jaaspire profile or the Platform in general (e.g., showing your profile in a list of top creators, or if you participate in an official Jaaspire promotion—we will not use your explicit content for marketing without consent, but we may use a SFW profile image or description).

Make backups of content to prevent data loss.

Sub-license to trusted third-party service providers as needed to provide the service (for example, caching by a content delivery network, search index creation, etc.).
This license continues for so long as your content is available on the Platform and for a reasonable period afterward (for example, to allow us to maintain backup copies or as required by law). The license ends when you or Jaaspire remove your User Content from the Platform, except to the extent that content has been shared with others and they have not deleted it, or has been licensed to Followers as described below.
8.8 License to Other Users (Followers). When you post content behind a paywall or subscription and another user (Follower) pays for access, you grant that Follower a limited, non-transferable license to access and view that specific content for their personal, non-commercial use. This license is conditional upon the Follower remaining a paying subscriber or having otherwise paid for the content. Followers do not acquire any ownership or the right to further use that content outside of Jaaspire. They must not download, screenshot, record, reproduce, or redistribute any Creator's content without explicit permission. Doing so violates these Terms and may result in account termination and potential legal action by the Creator for copyright infringement or other claims.
8.9 Your Responsibilities for Your Content. You are solely responsible for any User Content you create, upload, or share on Jaaspire. This means:

Legality and Rights: You represent and warrant that (a) you own or have all necessary rights and permissions to upload the content and to grant the licenses in these Terms, and (b) your content does not violate any law or any person's rights. You must have secured all necessary licenses, consents, and permissions (for example, releases from any person who appears in your content, or permission from the copyright owner if you include third-party music, images, etc.). If your content uses someone else's intellectual property (such as a song, artwork, or trademark logo), you must have the legal right to use it. Jaaspire is not responsible for verifying the ownership of content you post; that is your responsibility.

No Confidential Content: Any content you upload is non-confidential. Even if you restrict it to paying Followers, you understand that once it is online, we cannot guarantee it will not be copied or shared by others in violation of these Terms. (We take measures to prevent and address such violations—see Section 8.14—but we cannot promise it will never happen.)

Accuracy: If you provide informational content (for example, advice or statements), you are responsible for the reliability and accuracy of that content. We do not edit or verify user postings for accuracy.

Compliance: Your content must comply with these Terms, including the Acceptable Use Policy. If it does not, we may remove it and take action on your account.
8.10 Acceptable Use. Your use of the Platform and all User Content is subject to our Acceptable Use Policy, which is incorporated by reference. Content that is pornographic, lewd, or nude and primarily intended for sexual gratification is prohibited; artistic, medical, educational, fitness, and wellness content in appropriate contexts is permitted, as detailed in the Acceptable Use Policy.
8.11 Co-Authored Content. If your User Content features or includes any other person (for example, you collaborate with another Creator in a video, or someone else is photographed in your content):

Consent and Verification: You must ensure each person appearing in your content is at least 18 years old and has given their explicit, written consent to be featured. Any person who is identifiable in your sexually explicit content must be a registered Creator on Jaaspire who has passed our age and identity verification or has signed a Jaaspire-approved participant release form. You are responsible for collecting and maintaining any necessary release documentation. (This is important for legal compliance, including U.S. 18 U.S.C. §2257 record-keeping for sexually explicit content—see Section 8.12.)

Tagging/Attribution: Jaaspire may provide a feature to tag or identify co-authors or participants in content. If so, you should tag the co-creator's Jaaspire account or otherwise give them credit according to Platform guidelines.

Disputes Between Creators: If you upload content with a co-creator, you agree in advance how earnings or ownership of that content are handled between you. Jaaspire is not liable for any disputes between you and any co-authors of your content. By uploading co-authored content, you release Jaaspire from any claims arising from that content between you and the other participants.

Content Removal: If you or your co-creator deletes an account or removes content, that does not guarantee removal of the co-authored content if the other person has also posted it or if Followers have already paid for it. For example, if Creator A and Creator B make a video together and Creator A posts it, it may remain on Creator A's profile even if Creator B deletes their account (or vice versa). However, Jaaspire will consider requests to remove co-authored content if one party withdraws consent, on a case-by-case basis, especially for future sales. All involved parties must notify Jaaspire and possibly each other to reach a resolution. Jaaspire may remove co-authored content at our discretion if a dispute arises or if we believe it no longer meets our compliance requirements.
8.12 18 U.S.C. §2257 Compliance (Custodian of Records). For Creators producing adult-oriented or explicit content (as defined by U.S. law), you are considered the producer of that content for legal purposes. You agree to act as the "Custodian of Records" for all such content you upload, meaning you will obtain and keep records of the age and identity of all persons depicted in the content as required by law. Jaaspire is not the primary producer of user-uploaded content, and each Creator is responsible for maintaining age-verification documentation for their content and making it available upon lawful request. We may require you to provide copies of these records or certifications of compliance from time to time to ensure legal compliance. Failure to comply with these obligations can result in account termination.
8.13 Content Monitoring and Removal. Jaaspire is not obligated to pre-screen or monitor User Content, but we reserve the right to do so. We may remove, screen, or edit any User Content at any time and for any reason, including if we believe it violates these Terms or applicable law, or upon receiving any complaint or DMCA notice (see Section 9). The decision to remove content is at our sole discretion, and we may notify you of the removal along with the reason. We may sometimes remove content without notice if circumstances warrant (e.g., content is extremely harmful or urgent to remove).
8.14 Protection of Your Content (Anti-Piracy). We take the unauthorized distribution of User Content seriously. While Followers are not permitted to download or share Creators' content off-platform, we are aware that piracy can occur. If your content is found to be illegally distributed by someone (for example, a Follower leaks your photos/videos elsewhere):

Please notify us at [email protected] or via our DMCA/Copyright Infringement process. Provide evidence or links to the infringed content if possible.

We will make efforts to assist in preventing further distribution, which may include issuing takedown requests on your behalf or providing you with information to help enforce your rights.

However, Jaaspire is not liable for the actions of third parties who obtain content without authorization. We cannot guarantee complete removal of content from the internet outside our Platform, but we will support our Creators to the best of our ability in such situations.
8.15 User Content Disclaimer. We are not responsible or liable for any User Content posted by you or any other user on Jaaspire. We do not endorse or guarantee the truthfulness or reliability of any user-generated content. If you rely on information or materials shared by another user, you do so at your own risk. You agree that Jaaspire will not be liable for any claims or losses arising from User Content, whether caused by users or by any of the equipment or programming associated with or utilized by the Platform.
8.16 Compatibility and Updates. We strive to make Jaaspire accessible on a variety of devices and operating systems, but we do not guarantee that Jaaspire will be compatible with all devices, browsers, or system versions. It is your responsibility to ensure you have the necessary equipment, software, and internet connection to use Jaaspire. From time to time, we may release updates, bug fixes, or new features, and we may require you to update your app or browser to continue using Jaaspire. By using the Platform, you agree to receive such updates (automatically, in the case of mobile apps, if your settings allow). Failure to install updates may affect functionality, and we are not responsible for issues arising from failure to update.
9. 9. DMCA – Copyright Infringement Policy
9.1 Respect for Copyright. Jaaspire respects the intellectual property rights of others and expects our users to do the same. It is our policy to respond to clear and complete notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (DMCA) (17 U.S.C. § 512) and other applicable intellectual property laws.
9.2 Reporting Copyright Infringement. If you believe that any content on Jaaspire infringes your copyright (or the copyright of someone you represent), you may submit a DMCA notification to us. The fastest way is to email our designated Copyright Agent at [email protected].
9.3 What to Include in a Notice. For your DMCA notice to be effective, it must include (per 17 U.S.C. §512(c)(3)) the following:
9.3.1 A physical or electronic signature of a person authorized to act on behalf of the owner of the copyright that is allegedly infringed. (You may type your full legal name at the bottom of an email as your electronic signature.)
9.3.2 Identification of the copyrighted work claimed to have been infringed. Be specific. If multiple works are involved, you may provide a representative list (for instance, "the copyrighted photographs titled [Name] taken by [Your Name]").
9.3.3 Identification of the material claimed to be infringing, and information reasonably sufficient to permit us to locate it on Jaaspire. Please provide URLs or specific links to the content if possible, and the username of the person who posted it, if known. General descriptions like "a video I found on your site" are not sufficient.
9.3.4 Contact information for the notifying party, including your full name, mailing address, telephone number, and email address.
9.3.5 A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
9.3.6 A statement that the information in your notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act on the copyright owner's behalf.
If any of the above information is missing, we may not be able to process your request.
9.4 Our Response to DMCA Notices. Upon receipt of a valid DMCA notice, Jaaspire will:

Acknowledge that we received the notice (usually via email).
-
Remove or disable access to the allegedly infringing material on the Platform.
-
Notify the user (the "Uploader") who posted the material that it has been removed or disabled due to a DMCA complaint, identify the content removed, and advise the Uploader of their right to submit a counter-notification.
-
Keep a record of the notice for legal purposes.
We may also terminate the accounts of repeat infringers in accordance with our Repeat Infringer Policy (Section 9.7).
9.5 Counter-Notification. If you are a user who posted content that was removed due to a DMCA notice, and you believe the content was removed as a result of mistake or misidentification, you may submit a DMCA counter-notification to dispute the claim. Your counter-notification must include:

Your physical or electronic signature.
-
Identification of the material that has been removed or to which access has been disabled, and the location (URL) where it appeared before removal.
-
A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
-
Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court in the district where you reside (or, if you reside outside the United States, in King County, Washington), and that you will accept service of process from the person (or their agent) who provided the original DMCA notice.
You must send the counter-notice to the same designated agent ([email protected]). If we receive a valid counter-notification, we will forward it to the original complaining party. If the original copyright owner does not file a court action seeking an injunction against the user within 10–14 business days after we provide the counter-notice, we are legally permitted to restore the material, and generally will do so.
9.6 Misuse of DMCA. Filing a false DMCA notice or counter-notice can have legal consequences. Under the law, anyone who knowingly materially misrepresents that material is infringing, or that it was mistakenly removed, may be liable for damages (including costs and attorneys' fees).
9.7 Repeat Infringers. Jaaspire's policy is to terminate, in appropriate circumstances, the accounts of users who are repeat infringers. While the exact criteria are at our discretion, a common guideline is that a user who receives three valid DMCA complaints (that are not successfully counter-notified) for three different works may have their account terminated. We may also terminate accounts with fewer strikes in cases of egregious infringement or where we believe the user is willfully violating copyright on a broad scale.
9.8 Other Intellectual Property. For complaints about trademark infringement or other IP violations (not copyright), users should contact [email protected] with details. We may require similar information and will handle those complaints under applicable laws and our internal policies.
10. Account Deactivation and Termination
10.1 By You. You may stop using Jaaspire and request account deletion at any time, subject to the cancellation steps in Section 6 for active subscriptions. To deactivate or permanently delete your Jaaspire account, you may contact our support team at [email protected] with your request, or use any self-service account deletion function provided on the Platform. For security, we may require you to confirm your identity or ownership of the account. We aim to process account deactivation or deletion requests within a reasonable time (typically within 10 business days).
Effect of Deactivation or Deletion: Deactivating your account will remove your profile from public visibility and prevent any new subscriptions or interactions. However, any existing subscriptions or premium content may remain accessible to those Followers until the end of their current subscription period, unless we decide to remove content for policy reasons. If you request permanent deletion, we will generally remove or anonymize your personal data as described in our Privacy Policy, subject to retention obligations under applicable law.
If you have any unused Stars in your account at the time of deletion, you acknowledge and agree that, to the fullest extent permitted by law, those Stars will be permanently forfeited and are non-refundable and non-redeemable. You will not be entitled to any monetary compensation or credit for unused Stars upon account closure, unless required by applicable law. If you are a Creator and have an outstanding Creator Earnings balance that has not yet met the minimum payout threshold or is subject to a holding period or other restriction, Jaaspire may, at its sole discretion and subject to legal and compliance considerations, choose to pay out some or all of that balance or may deem some or all of it forfeited. Jaaspire will take into account factors such as applicable law, tax-reporting obligations, suspected fraud, and the reason for account closure.
Content Retention: Even after deactivation or deletion, we may retain certain data as required by law or for legitimate business purposes (for example, proof of transactions, tax records, or evidence in case of disputes). Co-authored content that you have participated in may remain on Jaaspire if it was posted by another Creator, even if your own account is deleted.
10.2 By Jaaspire. We may suspend or terminate your account at any time with or without notice if we reasonably believe that you have violated these Terms or any law, or if we believe it is necessary to protect our Platform or other users. In less severe cases, we may suspend your account's access to certain features (for example, disabling the ability to post content, purchase Stars, or withdraw Creator Earnings) while we investigate. If your account is terminated or suspended: you must stop using Jaaspire immediately; any subscriptions or Creator Earnings may be frozen or canceled; and any unused Stars in your account will be forfeited without compensation, subject to applicable law.
Creators whose accounts are terminated for cause (for example, for fraud, illegal content, or serious violations of our Acceptable Use Policy) forfeit any unpaid Creator Earnings, referral bonuses, or other benefits, especially if those earnings resulted from or were connected to the misconduct. You are not allowed to create a new account if your original account was terminated for a violation. Attempting to circumvent a ban is itself a violation.
10.3 Effect. On termination, your right to access the Platform ends. Sections that by their nature should survive (including payment obligations, license grants, disclaimers, limitation of liability, indemnification, and dispute resolution) survive termination.
10.4 Appeals. If you believe your account was wrongfully suspended or terminated, you may contact [email protected] to request a review. We will inform you of the reason for termination, if legally permissible. However, Jaaspire's decision on termination is final and at our sole discretion, and these Terms do not guarantee reinstatement.
11. Disclaimer of Warranties
Use of Jaaspire is at your own risk. The Platform is provided "as is" and "as available." By using Jaaspire, you acknowledge and agree to the following:
11.1 No Guaranteed Outcomes. Jaaspire and all of its services and features are provided without any warranties of any kind, express or implied. To the fullest extent permitted by law, Jaaspire (including our affiliates, and our and their respective officers, directors, employees, and agents) disclaims all warranties, express or implied, related to the Platform, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We make no promise that:

Jaaspire will meet your specific requirements or expectations.
-
The Platform will be available on an uninterrupted, secure, or error-free basis 100% of the time. (We may have downtime for maintenance, or there could be technical issues beyond our control.)

The content provided on the Platform (whether by us or by users) is accurate, complete, or reliable. User Content is largely produced by users, and we do not guarantee its quality or truthfulness.

Any errors or defects on the Platform will always be corrected.
-
The Platform or any content is free of viruses or other harmful components, though we do take security measures.
11.2 User Precautions. You are responsible for implementing reasonable precautions to protect yourself and your devices, including using up-to-date antivirus software, exercising caution when interacting with other users or downloading content, and backing up any data that is important to you. If you lose data or your system is damaged by using Jaaspire, we are generally not liable (to the extent allowed by law).
11.3 Third-Party Content and Interactions. We do not control third-party communications or content you might receive through Jaaspire (for example, messages from other users or links other users share), and we cannot control what users do with the content they access. Therefore:

We do not warrant or guarantee any specific results from use of the Platform. For example, we do not guarantee that Creators will achieve any particular level of income or that Followers will find the content they desire.

Any reliance you place on information or materials obtained on Jaaspire is strictly at your own risk. We disclaim all liability for actions you take based on information you find on the Platform (unless we explicitly provide official information, e.g., in our help center).

If you meet or communicate with other Users off the Platform or engage in transactions outside Jaaspire, we are not responsible for what happens.
11.4 Service Availability. While we aim for high uptime, Jaaspire does not warrant that the service will be uninterrupted or available at any particular time or location. Downtime may occur. We reserve the right to suspend all or part of the service for technical reasons or emergencies.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above disclaimers may not apply to you. In such jurisdictions, warranties are disclaimed to the fullest extent permitted by law.
12. Limitation of Liability
12.1 Indirect Damages. In no event will Jaaspire or its affiliates, or their respective officers, directors, employees, agents, or shareholders, be liable to you for any indirect, consequential, exemplary, incidental, special, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, service interruption, computer damage, system failure, or the cost of substitute services, arising out of or in connection with your access to, use of, or inability to use Jaaspire or any content on the Platform, even if we have been advised of the possibility of such damages. This holds true under any theory of liability (whether based in contract, tort, negligence, strict liability, or otherwise).
12.2 Direct Damages Cap. To the extent any liability is found despite the above disclaimer, the total aggregate liability of Jaaspire and its affiliates (and their officers, employees, and agents) to you for any claim arising out of or relating to these Terms or your use of the Platform is limited to the greater of: (a) the total amount of fees you paid to Jaaspire in the 12 months preceding the claim; and (b) USD $100. This cap applies in the aggregate to all claims and does not reset per claim. If you have not paid anything (for example, a Follower with only free subscriptions, or a visitor), our maximum liability will be $100.
Nothing in this Section 12 limits, reduces, or offsets Jaaspire's obligation to remit Creator Earnings actually due and payable to a Creator under Sections 4 and 5, which constitutes a debt owed rather than damages. The limitations in this Section 12 form an essential basis of the bargain between you and Jaaspire and apply even if a limited remedy fails of its essential purpose.
12.3 User Content Liability. Jaaspire specifically disclaims any liability for the illegal or unauthorized distribution of your User Content by other users. As described in Section 8.14, if another user or outside party misuses your content, we will help to the extent we can, but we will not be liable for the initial act of distribution by that party.
12.4 Exceptions. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not fully apply to you. Any liability that cannot be excluded or limited under law is not excluded by these Terms; in those cases, our liability is limited to the smallest amount permitted by law.
12.5 Release. You release Jaaspire and our affiliates and agents from any and all claims, demands, and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with disputes between you and any other user of the Platform. If you are a California resident, you waive California Civil Code §1542, which says: "A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor." (In plain language, you are waiving any unknown claims.)
13. Indemnification
13.1 Indemnity. You agree to indemnify, defend, and hold harmless Jaaspire, its parent company, affiliates, and their respective officers, directors, employees, and agents (collectively, the "Jaaspire Parties") from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:
13.1.1 Your use or misuse of Jaaspire or its services/features.
13.1.2 User Content you create, post, or share through Jaaspire (including any allegations that your content infringes or misappropriates the intellectual property or privacy rights of a third party, or that it defames someone).
13.1.3 Any interactions or transactions between you and other users (for example, disputes between a Follower and a Creator regarding content delivery, or between Creators collaborating on a project).
13.1.4 Your violation of these Terms or of any law or regulation.
13.2 Cooperation. Jaaspire reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You will not settle any such claim without our prior written consent. We will use reasonable efforts to notify you of any claim subject to this indemnification upon becoming aware of it.
13.3 Continued Obligation. This indemnification obligation will survive termination of your account or these Terms. Even if you delete your account or stop using Jaaspire, you could still be responsible for costs related to things that happened while you used the Platform.
14. Dispute Resolution and Governing Law
14.1 Governing Law. These Terms, and any dispute or claim arising out of or related to them or your use of Jaaspire, are governed by and construed in accordance with the laws of the State of Washington, USA, without giving effect to any conflict-of-laws principles, except where mandatory consumer-protection laws of your country of residence apply. If you reside outside the governing jurisdiction, nothing in this clause overrides any rights you may have under mandatory local laws.
14.2 Binding Individual Arbitration.
(a) Agreement to Arbitrate; Federal Arbitration Act. You and Jaaspire agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Platform, Stars, subscriptions, payouts, or your relationship with Jaaspire (a "Dispute") will be resolved exclusively by final and binding individual arbitration, rather than in court, except as expressly provided in subsections (g) and (h). This Section is governed by the Federal Arbitration Act, 9 U.S.C. §§ 1–16 ("FAA"), and evidences a transaction involving interstate commerce. This arbitration agreement survives termination of these Terms and of your account.
(b) Informal Resolution First. Before initiating arbitration, the complaining party must send a written Notice of Dispute to the other (to Jaaspire at [email protected]) describing the claim and the relief sought, and the parties will negotiate in good faith for at least thirty (30) days. This step is a condition precedent to arbitration, and any applicable limitations period is tolled while it is pending.
(c) Arbitration Provider and Rules. The arbitration will be administered by JAMS under its rules in effect when the demand is filed—the JAMS Streamlined Arbitration Rules for claims under USD $250,000 and the JAMS Comprehensive Arbitration Rules otherwise—as modified by this Section. Where you are an individual using the Platform for personal, household, or consumer purposes, the JAMS Consumer Arbitration Minimum Standards also apply and control over any conflicting provision of this Section. The JAMS rules are available at jamsadr.com.
(d) Seat and Governing Venue. The legal seat of the arbitration is King County, Washington, USA. The arbitration agreement and any judicial proceedings to compel, enforce, vacate, or confirm an award are governed by the FAA and, secondarily, by the laws of the State of Washington without regard to conflict-of-laws rules. The state and federal courts located in King County, Washington have exclusive jurisdiction to enforce this Section and to confirm or vacate any award.
(e) Location of Hearings. Notwithstanding the seat in subsection (d), and consistent with the JAMS Consumer Arbitration Minimum Standards, any in-person hearing for a consumer will be held in the county of the consumer's residence or, at the consumer's election, conducted by telephone or videoconference. A documents-only proceeding is available for smaller claims. Nothing in subsection (d) requires a consumer to travel to King County for any hearing.
(f) Arbitrator's Authority; Delegation. A single arbitrator will decide the Dispute. Threshold questions concerning the existence, scope, enforceability, and interpretation of this Section—except the Class Waiver in subsection (i), which is reserved exclusively for a court—are delegated to the arbitrator. The arbitrator may award any relief available to an individual party under applicable law, is bound by these Terms, and will issue a reasoned written award.
(g) Small-Claims Exception. Either party may instead bring an individual claim in a small-claims court of competent jurisdiction, so long as the matter remains in that court and proceeds on an individual, non-class basis.
(h) Intellectual Property and Injunctive Relief. Notwithstanding the foregoing, either party may bring an action in the courts of King County, Washington seeking temporary or preliminary injunctive or equitable relief to protect intellectual property rights or confidential information, or to prevent unauthorized access to or misuse of the Platform, pending resolution of the arbitration.
(i) Class and Representative Action Waiver. All Disputes must be brought in an individual capacity only. You and Jaaspire waive any right to bring or participate in a class, collective, consolidated, or representative action, and the arbitrator may not consolidate more than one person's claims or preside over any class or representative proceeding. If this Class Waiver is found unenforceable as to any Dispute, that Dispute (and only that Dispute) will be severed and heard in court; the remainder of this Section 14.2 remains in force. This subsection is non-severable from the agreement to arbitrate to the extent any portion of it is held invalid.
(j) Mass-Filing / Batch Arbitration. If 25 or more demands of a similar nature are filed by or with coordinated counsel, the parties agree the demands will be administered by JAMS in staged batches of no more than 50 to control fees, with a single arbitrator per batch, and the limitations period for all such claims is tolled while batches proceed.
(k) 30-Day Right to Opt Out. You may opt out of this Section 14.2 within thirty (30) days of first accepting these Terms by sending written notice with your name, account, and a clear statement that you decline arbitration to [email protected]. Opting out affects only this arbitration provision; it does not affect any other part of these Terms, and it will not adversely affect your relationship with Jaaspire. If you opt out, disputes proceed in the courts identified in subsection (d).
(l) Fees. Payment of filing, administration, and arbitrator fees is governed by the JAMS rules and, for consumers, by the JAMS Consumer Arbitration Minimum Standards, which cap the consumer's share. Where those Standards apply, Jaaspire will pay the fees they require Jaaspire to pay.
(m) Severability and Survival. Except as stated in subsection (i), if any portion of this Section 14.2 is held invalid or unenforceable, the remainder remains in effect. This Section survives termination of these Terms.
14.3 Class Action and Jury Trial Waiver. You and Jaaspire agree that any proceedings to resolve or litigate any dispute will be conducted solely on an individual basis, and neither party will seek to have any dispute heard as a class action, representative action, collective action, or private attorney general action. To the extent permitted by law, both you and Jaaspire waive any right to a jury trial in any litigation arising out of or related to these Terms or use of the Platform.
14.4 Time Limit to Bring Claims. Any cause of action or claim you may have arising out of or relating to these Terms or your use of Jaaspire must be commenced within one (1) year after the cause of action accrues; otherwise, such cause of action or claim is permanently waived and barred.
15. Referral Program
15.1 Referral Links. Jaaspire may offer a referral program to reward users for inviting new Creators or Followers to the Platform. If a referral program is in effect, each User may receive a unique referral URL or code ("Referral Link") which can be shared with others. When a new user signs up through your Referral Link, they may be attributed as your referral in our systems.
15.2 Referral Rewards. If a referral program is active, Jaaspire may pay referrers a bonus or commission based on the referred user's activity. For example, Jaaspire might pay you 30% of the referred Creator's net Creator Earnings for a set period months on the Platform. Specific details (rate, duration, eligibility, payout thresholds, and calculation method) will be as communicated in the referral program terms or in your account dashboard. Referral bonuses are paid out by Jaaspire and are funded from Jaaspire's share of platform revenue; they do not reduce the referred Creator's agreed revenue share or alter the value or number of Stars in circulation.
15.3 Successful Referral Conditions. To ensure you get credit, the new user must sign up using your exact Referral Link or code and meet any other conditions we specify (for example, minimum activity levels, passing identity checks, or compliance with our policies). Referrals are typically tracked via cookies or the unique code in the URL. If the new user does not use your link or code (for example, they visited the site directly), we cannot retroactively credit you as the referrer. Referrals count only if the new user is genuinely new (not someone who previously had an account).
15.4 Referral Restrictions. You must not violate any spamming laws or guidelines when sharing your Referral Link and must not misrepresent Jaaspire or your relationship with Jaaspire when promoting your Referral Link. You may not run advertisements pretending to be Jaaspire to funnel sign-ups through your link, nor use Jaaspire's branding in a confusing or unauthorized manner. You may not refer yourself, create fake or duplicate accounts, use bots, or otherwise manipulate the referral program. Any indication of fraudulent referrals will lead to loss of referral rewards and may result in account termination.
15.5 Program Changes. Jaaspire reserves the right to modify, suspend, or terminate the referral program at any time, for any reason. If the program is terminated or changed, we will honor referral rewards that have already been validly earned up to that point under the terms then in effect, but no new referrals may be earned under the old terms after the change. We will notify users of significant changes to referral terms.
15.6 Payout of Referral Earnings. Referral earnings (if any) will typically be paid according to the same schedule and methods as Creator Earnings, or on a separate schedule designated for referral bonuses, and may appear in your Creator account balance or a separate referral balance. We may impose minimum payout thresholds and holding periods for referral earnings similar to those for Creator Earnings. If we suspect referrals are fraudulent, abusive, or in violation of these Terms, we may withhold or reverse referral payments pending investigation.
16. Linking To and From Jaaspire
16.1 Linking to Our Site. We welcome Users and others sharing links to Jaaspire. You may create a hyperlink to Jaaspire's homepage (or your own profile or another Creator's profile) provided you do so in a way that is fair, legal, and does not damage our reputation or take advantage of it. This means:

You must not establish a link in a manner that suggests any form of association, approval, or endorsement by Jaaspire where none exists.
-
You should not use our logo or graphics to link without permission, aside from any branding resources we explicitly make available for users to promote their profiles.
-
If we request that you remove a link to our site, you agree to remove it promptly.
16.2 No Framing. You may not "frame" or embed our website in another site in a way that presents it as part of another website, without our prior written consent. You may not directly link to or embed content from Jaaspire that is behind a login/paywall (such as a direct link to an image or video URL on our CDN) on an external site, as this can circumvent our security.
16.3 Social Media Features. Jaaspire may provide certain social media features that enable you to link from your own or certain third-party websites to certain content on Jaaspire; send communications or content from Jaaspire to third-party services (for example, a "Share" button); or cause limited portions of content on Jaaspire to display on your own or certain third-party websites. 16.5 Right to Disable Links. We reserve the right to disable or withdraw linking permission without notice if we deem a link or use of our content to be inappropriate or in violation of these Terms.
16.6 Third-Party Links from Jaaspire. Jaaspire may contain links to other websites or resources provided by third parties. These links are provided for your convenience only, and we have no control over the content on those third-party sites or resources. The inclusion of any link does not imply endorsement by Jaaspire of that site or any association with its operators. If you decide to access any third-party websites linked from Jaaspire, you do so at your own risk; such sites have their own terms of service and privacy policies, which we encourage you to review. Any dealings you have with advertisers or other third parties found on or through Jaaspire are solely between you and that third party, and you agree that we will not be liable for any loss or claim arising from them.
17. General Provisions
17.1 No Waiver. No waiver by Jaaspire of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of that term or any other term, and any failure by Jaaspire to assert a right or provision under these Terms does not constitute a waiver of that right or provision. If you breach one of these Terms and we do not take action, we still reserve the right to take action for that breach or similar future breaches.
17.2 Severability. If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, that provision shall be eliminated or limited to the minimum extent necessary such that the remaining provisions of the Terms will continue in full force and effect.
17.3 Entire Agreement. These Terms of Service (along with any documents expressly incorporated by reference, such as our Privacy Policy and any community guidelines or additional terms provided within the Platform) constitute the entire agreement between you and Jaaspire regarding your use of the Platform. They supersede and extinguish all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Platform. If you are reading these Terms in a language other than English, note that any translations are for convenience; the English version is legally authoritative unless we specify otherwise.
17.4 No Third-Party Beneficiaries. These Terms are for the benefit of you and Jaaspire (and our affiliates and successors) only. They are not intended to confer any rights or remedies on any third parties, except as expressly stated (for example, the indemnified Jaaspire Parties under Section 13 and Apple under Section 6.6 are intended beneficiaries to enforce those rights).
17.5 Headings. The section titles and headings in these Terms are for convenience only and have no legal or contractual effect.
17.6 Survival. Provisions that by their nature should survive termination—including Sections 4 (residual obligations), 5, 8, 10.3, 11, 12, 13, 14, and 17—survive termination of these Terms or your account.
